USES Guest shall use the Premises only as a temporary, short-term, vacation residence and shall not use the Premises for any other purpose including but not limited to commercial, illegal or nuisance activities. Guest shall not cause any noise or disruption to other residents in the building and shall not receive complaints from other residents or building management. The Premises shall only be occupied by Guest and approved travel companions and not by any other friends, relatives or acquaintances, without first obtaining Company’s written consent. The Guest shall not keep any pets without written consent from the Company. 

CONDITION OF PREMISES The Premises is fully furnished as is. Company may provide Guest with a written inventory upon arrival. Guest may inspect premises to be sure they are satisfactory. Premises should be left in the condition it was in upon arrival. Company or its representative shall inspect the apartment to be sure it is clean and that no loss has occurred or damage been done to the premises or property listed in the inventory. There will be NO SMOKING of any kind in the Premises by Guest or anyone associated with Guest. Breaching any of these requirements will result in a penalty fee.

SECURITY DEPOSIT PROTECTION for a nominal fee this plan protects you from accidental damage or a theft within the unit up to $5,000.  You must notify MetroFlats, LLC of any damage or theft to the unit during your occupancy.  Purchasing the plan in lieu of a Security Deposit does not negate your responsibility as a tenant.  All units are carefully inspected after each rental.  Please refer to the enclosed plan information detailing terms, conditions and responsibilities of the tenant.

As part of your stay you may purchase a Rental Unit Damage Protection plan designed to cover unintentional damages to the rental unit interior that occur during your stay. If purchased, the policy will pay a maximum benefit of $5000. Any damages that exceed $5000 will be charged to the credit card on file. If, during your stay at one of our Rental Properties, an Insured Person causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or replacement of such property up to a maximum benefit of $5000. Certain terms and conditions apply.  Full details of the Rental Unit Damage Protection coverage are contained in the Certificate of Insurance or Insurance Policy.  The Rental Unit Damage Protection can be purchased up to, and including at, check-in. By submitting payment for this plan, you authorize and request CSA Travel Protection and Insurance Services to pay directly Metro Flats LLC any amount payable under the terms and conditions of the Rental Unit Damage Protection.   

PAYMENT AND SECURITY DEPOSIT Any and all damages to the property or negligence resulting in damage to the property or contents the Company shall charge the proper amount of money to repair said damage or loss of contents. If there is damage to the Premises or inventory that is lost or the Premises is not clean, Company shall charge the proper amount of money to restore condition of Premises. Guest will be charged for any expenses to clean or repair any of the contents of in the Premises. Guest(s) shall be solely responsible for any property damage, accident/injury to any person or loss sustained by any person, including loss of money, jewelry and other items of personal property, arising out of or in any way related to Guest(s) use of premises or the items of personal property provided by MetroFlats at Guest(s) request. Company and Agent are not responsible for articles left on premises. There will be a $10 charge in addition to shipping charges for handling the return of any articles found by housekeeping.

UNFORESEEN EVENTS Guest understands that unforeseen events may occur during their stay that is outside the control of Company.  Unforeseen events include but are not limited to power outages, water outages, plumbing issues and general apartment city living issues.  Where Company will do its best to accommodate Guest during these unforeseen events Guest understands that Guest will not be able to receive monetary compensation.

CANCELLATION POLICY A full refund will be issued if notified of cancellation four (4) weeks prior to arrival. 75% is refund will be issued if notified of cancellation three (3) weeks prior to arrival. 50% refund will be issued if notified of cancellation two (2) weeks prior to arrival. 25% refund will be issued if notified of cancellation one (1) week prior to arrival. 0% refund will be issued if notified of cancellation under one (1) of arrival. A charge back of 2% will be applied as a refund-processing fee.

TRAVEL INSURANCE The premium for Vacation Rental Insurance has been included in the cost of your initial deposit.  Vacation Rental Insurance reimburses for pre-paid non-refundable expenses due to certain unforeseeable circumstances that may cause you to cancel, interrupt or delay your trip.  Please review our cancellation policy above. By declining this coverage, you acknowledge you have read and understand our cancellation policy and choose NOT to purchase Vacation Rental Insurance.  Please subtract the insurance premium from your initial deposit. 

GUEST AGREES To insure his/her personal property. Utilities are included in the price for rentals under 21 days. Long distance telephone calls, toll calls and pay-per-view cable are not included in the price. During reasonable hours with prior notice to Guest, Company shall have the right to show the premises or enter for the purpose of inspection or repair. Company shall not be responsible for any injury, loss or damage to Guest’s belongings other than as a result of Company’s gross negligence. Guest must notify Company immediately of any dangerous or hazardous or unsafe conditions. If keys are lost, Guest will contact Company immediately and Guest will be responsible for any and all expenses incurred in replacing the lost keys or the lock or the door. Any breach of this agreement is cause for Company to have Guest immediately vacate the Premises and Guest will forfeit any payments. 

LOST KEYS If keys are lost, Guest will contact Company immediately and Guest will be responsible for any and all expenses incurred in replacing the lost keys or the lock or the door. Once the Company has been contacted, Company will arrange for another check-in to occur within 24 hours of being contacted. Guest will be charged $65 for an Emergency Key Drop Off and $80 for Lost Key Replacement. Guests are strongly advised to NOT lose keys because the Company has up to 24 hours to provide reentry. Guests will be displaced until the Company can send a representative to the apartment. Guests will not receive any monetary compensation should they be locked out of the Premises and be displaced for any length of time under 24 hours.

MISCELLANEOUS This agreement represents the entire agreement and understanding between Company and Guest. Any modification or addition to this agreement shall be in writing and signed by both parties. Guest cannot access the Premises before the scheduled check-in time and Guest must vacate the Premises at the scheduled check-out time, unless changes have been agreed to with Company.

EXTRA CARE PACKAGE Guests who purchase the MetroFlats Extra Care Package are giving the Company permission to enter the Premises anytime between 9:30am and 12:00pm, of the days Extra Care Package is valid, as part of the cleaning services from this package,

8) Late Check-ins or outs: $15.99 per hour
9) Early Check-ins: $15.99 per hour
10) Noise Fee – Guests are urged to respect their neighbors. Complaints from other residents due to noise will result in a penalty charge - $50
 
Additional Fees Due to Damages
11) Bedding/Linen Replacement (due to damage) - minimum $45 per item
12) Towel Replacement (due to damage) - minimum  $15 per towel
13) Standard Smoking Penalty Fee: minimum -  $125
14) Broken Glasses/Bowels/Plates/Dishes - $15 per item
15) Any damages to the apartment or the unit’s contents will be appropriately assessed and charged according to our guest agreement
